Federal judge halts Trump’s election executive order seeking to create a federal voter list

BOSTON (AP) — A federal judge on Thursday halted President Donald Trump’s         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/donald-trump-mail-voting-elections-47cc334b1fb7742244a9c4f176b355cd">executive order that sought to create a federal voter list and limit who can receive a mail ballot.

U.S. District Court Judge Indira Talwani, who was nominated by Democratic President Barack Obama, sided with a coalition of nearly two dozen states that challenged the Republican president’s order in granting a summary judgment. Her ruling applies to this year’s midterm election cycle.

Plaintiffs         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/trump-mailin-voting-lawsuit-0605d78112c6a1cb8685ca0f053a79b8">argued in two lawsuits, both filed in federal court in Boston, that Trump’s order should be         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/trump-election-executive-order-democrats-voter-list-ac61e7d4bb77f9901eb6f1a2c1f4b087">found unconstitutional because the states and Congress, not the president, have the power to set election rules. The judge agreed, noting in her ruling that the provisions of Trump’s order “unconstitutionally violate the separation of powers.”

It was the second ruling in as many days against executive orders Trump has signed seeking oversight of the nation’s elections. A         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/trump-elections-judge-358912bcb6c7223b3d2d36465156fde9">separate ruling Wednesday prohibited an executive order he had signed last year that would have required people to show documents proving their citizenship when registering to vote.


   
       
   

The administration, in its motions to dismiss the lawsuits challenging the order seeking to establish a federal voter list, argued that the motions are premature and that plaintiffs lacked the legal basis to bring their claim based on the Administrative Procedure Act, which governs how federal agencies develop and issue regulations.




   
       




   


But in an interim order before Thursday’s ruling, Talwani said the motions pertaining to this year’s election cycle were relevant: “In light of the EO’s specific deadlines over the next three months, and the reality that elections will be occurring throughout this period with the November 3, 2026 midterm occurring in just five months, postponing judicial review is impracticable and may inflict significant hardship on Plaintiffs,” she wrote. Trump’s executive order, the second one         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/voting-elections-trump-executive-order-4e9edb53f47e61e241a43ceef8164022">aimed at elections during his second term, comes as he continues to raise the specter of widespread voting by noncitizens as a reason to change election rules. But states already have detailed processes aimed at keeping their voter rolls accurate, and voting by noncitizens has been         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/noncitizens-voting-republicans-election-2024-immigration-09b86e6768f755fd875f3c51b0e8ea70">shown to be rare. It also is         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/2022-midterm-elections-noncitizens-voting-question-d720a6d02e066700d86812dc717906e5">a felony that can be punishable by deportation.


   
       
   

Trump issued his second order in March after a bill he supported to overhaul voting         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/voting-bill-citizenship-senate-thune-trump-3709f2bd02d2c841e16d501529ec9198">stalled in Congress. The order would have had the federal government create a list of eligible voters and then directed the U.S. Postal Service to deliver mail ballots only to those on the list. Election officials argued that it was ripe for abuse and could cause chaos, and the postal union has         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/postal-service-mail-voting-trump-midterms-d0883d8064fd512565e8b07e373a5a66">objected to the idea of mail carriers policing ballots.

The Postal Service has published         data-gtm-enhancement-style="LinkEnhancementA" href="https://public-inspection.federalregister.gov/2026-10968.pdf" target="_blank" rel="noopener">a proposed rule required by Trump’s executive order in the Federal Register. Among other things, the rule would not apply to primary elections or overseas ballots.


   
       
   

The lawsuit seeking summary judgment was filed by Democratic attorneys general representing 22 states and the District of Columbia. Also signing on were attorneys representing Democratic Gov. Josh Shapiro of Pennsylvania, which has a Republican attorney general.

The states also told the court that the move imposes a costly burden on election officials to comply and would spread fear about the possibility of prosecution. Stephen Pezzi, a lawyer for the Trump administration, had argued that no one would be prosecuted for violating the order.

In a separate lawsuit filed against the executive order, a federal judge in Washington, D.C., in May         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/trump-elections-mail-voting-executive-order-9474fae41161dc5954295ae1370bcb88">agreed with the Trump administration that it was too early to block the order because it had yet to be implemented. That lawsuit was brought by Democratic and civil rights groups, who have appealed.

Since his 2020 presidential election         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/election-claims-biden-won-explained-bd53b14ce871412b462cb3fe2c563f18">loss to Democrat Joe Biden, Trump has groundlessly claimed mail voting is rife with fraud and has         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/trump-special-prosecutor-2020-biden-election-194b3d49f49b0345f77873fc34b4dcc5">launched a federal investigation into that year’s vote, even though         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/joe-biden-wisconsin-presidential-elections-state-elections-madison-9a2f172dd8074668ded26bd5b0b41fbb">repeated audits and investigations, including         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/donald-trump-joe-biden-election-2020-elections-government-and-politics-4b6643aa699480dc63cbce8555aac946">ones run by Republicans, found it was         data-gtm-enhancement-style="LinkEnhancementA" href="https://apnews.com/article/elections-government-and-politics-nevada-ed4d5296d9fd7fd9afd83a3fe845c205">free of widespread fraud.
